Terms & Conditions

BY PAYING FOR A COACHING PROGRAMME, OR SERVICE FROM COACHING IN FLOW EITHER IN PARTIAL OR IN FULL, YOU AGREE TO THE TERMS BELOW:

You agree to enter into this Agreement with Domingo Jones Ltd (registered name of Coaching in Flow the ‘company’ or ‘we/us’) Sally Domingo-Jones (the “Coach”), then this Participant Agreement (the “Agreement”) automatically becomes a binding contract between you and the Company, and applies to your participation in any programme or service offered by the Company. By paying for this service, you agree to these Terms and Conditions, without modification, and acknowledge reading them.

CREATING, RE-ARRANGING AND CANCELLATION OF APPOINTMENTS

●      For group online programmes dates are pre-set and arranged as per the course schedule

●      For Workshops/Speaking engagements/Coaching creating appointments will usually be agreed in advance

●      If client needs to re-arrange or cancel an appointment this must be requested at least 48hrs before the original appointment date

●      If the request to re-arrange is within 48 hours of the appointment date, and a mutually convenient alternative date cannot be found within the same month, full cost will be charged unless exceptional circumstances are present such as unforeseen illness or difficulties

●      For the coach, in exceptional circumstances such as illness or difficulties, she reserves the right to re-arrange or cancel an appointment at any time. This will be done with the greatest notice and all appointments re-scheduled or refunded where this is not possible within an appropriate time limit

CONFIDENTIALITY & RIGHTS

●      All client conversations are confidential

●      Under the terms of the Data Protection Act 2018, the Coach will keep on record basic client information (e.g. contact details) as is necessary

●      Client understands that the confidentiality of others on a group programme is paramount and anything shared in the group environment is kept confidential

●      All client notes remain unidentifiable, remain on a locked computer and are only accessible by the Coach

PAYMENTS & BILLING

●      Initial half-hour consultation is complimentary

●      Rates are allocated by the hour, a day rate or by package supplied

●      Invoices are to be settled prior to programme or service delivery for a one-off one-to-one coaching session. For longer coaching programmes, payment can be pro-rated on a monthly basis for the duration of the coaching agreement provided that the entire coaching programme is paid in full no later than 15 days before the end of the coaching programme. The start date for coaching begins upon receipt of first payment for coaching services. Subsequent payments are due one calendar month after receipt of the first payment until the balance has been paid in full. 

●      Payment to be made by direct bank transfer to Domingo Jones Ltd.

CLIENT EXPECTATIONS

●      Client commits to full participation in their programme, course, or coaching sessions

●      Client understands that they are 100% responsible for their own progress and results

●      Client understands that results are expected, however they cannot be guaranteed

●      Client understands that results will vary depending on their need, desire for change, commitment and other internal or external factors which the coach is committed to working with the client on

Description of Coaching: Coaching is partnership (defined as an alliance, not a legal business partnership) between the Coach and the Client in a thought-provoking and creative process that inspires the client to maximize personal and professional potential. It is designed to facilitate the creation/development of personal, professional or business goals and to develop and carry out a strategy/plan for achieving those goals.

●      Client understands coaching is not therapy and does not substitute for therapy if needed, and does not prevent, cure, or treat any mental disorder or medical disease.

●      Client understands they are at liberty to discuss any of the above with the coach herself to ensure the best progress can be reached for the client and results are achieved to their expectations

COACH EXPECTATIONS

●      The Coach guarantees to do her best work possible

●      The Coach will not be liable for adverse changes that occur as a result of the coaching process

INTELLECTUAL PROPERTY

●      Coach and Client agree that all inventions, trade secrets, confidential and/or proprietary information, and work-product conceived, created or developed by each of the Parties, respectively, will be the sole and exclusive property of the Party to whom the information originally belonged. There shall be no transfer of intellectual property through this Agreement.

TERMINATION AND REFUNDS

●      Either the Client or the Coach may terminate this agreement at any time by giving two weeks’ written notice. Otherwise the coaching will continue for the duration of the contracted period.

●      Client agrees to compensate the Coach for all coaching services rendered up to and including the effective date of termination of the coaching relationship.

●      There are no refunds offered for coaching or other services rendered as once we spend our time with you we can’t get it back. As above, if a coaching programme is terminated before its conclusion then the Client will only be liable for payment up to and including the effective date of termination.

 

LIMITATION OF LIABILITY

●      Except as expressly provided in this agreement, the Coach makes no guarantees or warranties, express or implied. In no event will the Coach be liable to the Client for consequential or special damages. Notwithstanding any damages that the Client may incur, the Coach’s entire liability under this agreement, and the Client’s exclusive remedy, will be limited to the amount paid by the Client to the Coach under this agreement for all services rendered up until the termination date.

COMPLAINTS PROCEDURE

●      I am bound by the EMCC Code of Ethics and am committed to abide by the code. The code is here and details of the complaints procedure are here. In the first instance of any complaints, I would encourage clients to speak to me directly if it is reasonable and practicable to do so, but should their issues not be resolved satisfactorily, they can launch a formal complaint with EMCC UK.
